Its unusual that Bill Cash ever states anything in public that I agree with, however this morning he was interviewed on Radio 4 Today by Mishal Husain and I have to confess he and I are of the same perspective, even though we have different reasons or rather are hoping for different outcomes. The question related to the publication by the Government of the Attorney Generals advice to the Prime Minister and the Cabinet over the Brexit proposed deal. Not only do Bill and I bothbelieve this is important, but Bill went further and suggested that in his opinion the current Brexit proposal is conflicting with the Bill passed by Parliament back in March 2017 relating to our departure. Now I have no idea if that is the case or not, but it is interesting. However the publication of legal advice from an Attorney General was challenged by Mishal and she got it so wrong. Her line was that if the Attorney General is providing advice to the PM or Cabinet, that they would not do so openly or clearly if they knew it would be published. The reality is that any legal adviser, whilst paying close attention to the immediate audience will also ensure that they give advice in a manner that will not put them into a place of high risk if the audience then choose to publicise the advice. It is for this reason I believe that all advice presented to the Cabinet needs to be made public, albeit that some of this advice should not be published during the lifetime of the Parliament and clearly the advice should be redacted in the case of individuals or nations where there is risk for people or economies. However to treat the norm as being not publishing such matters is deeply out of date with a society that is supposed to have an accountable Government!
